The purpose of this Privacy Policy is to outline the principles governing the collection and processing of personal information by AdTech Lab d.o.o. We respect and value the privacy of all our customers and will only collect and use personal data in ways that are described here and in a way that is consistent with our obligations and your rights under the law. 

We respect the confidentiality of your personal data and always act in accordance with the applicable laws and regulations governing the protection of personal data, as well as the provisions of this Privacy Policy. 

For the reasons mentioned above, we have prepared this detailed Privacy Policy to inform you transparently and comprehensively about the processing of your personal data. Firstly, we want to inform you about (i) the personal data we collect, (ii) the purpose for which we collect them, and (iii) your direct rights regarding the processing.

With respect to the processing of personal data mentioned in this Privacy Policy, AdTech Lab d.o.o., with its registered office in Zagreb, Ulica Vjekoslava Klaića 15, OIB: 56742805956 (“ATL”) is the data controller within the meaning of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”).

INFORMATION WE COLLECT 

Our Service: We may collect personally identifiable information about you through our Service when you register for an account, such as your full name, phone number, and email address. If you choose to purchase a product from us, we or our third-party payment processors will collect your payment information as well. We also collect data through our partners (customers) who use our Service (including by embedding our code on their websites) to analyze the usage of their websites. When you use our Service or visit such websites, your browser may send us certain information about you as described below. We do not send any promotional emails; however, we may send you service-related emails related to your account. If you no longer wish to receive these emails, you may opt-out of them by cancelling your account.

Cookies and Tracking Technologies: We and our partners (such as advertising, marketing, and analytics), affiliates, or analytics or service providers may use technologies such as cookies, beacons, tags, and scripts. These technologies are used to analyze trends, administer the site, track users’ movements around the site, and gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as an aggregated basis. Our partners may also use such technologies to deliver advertisements to you as described below.

We use cookies to remember users’ settings, authentication, preferences, and analytics. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features, ads, or areas of our site may be limited.

Log File Information: Log file information is automatically reported by your browser each time you access a web page on our Service. When you access the Service, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring/exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information. We do not link this automatically-collected data to personally identifiable information.

We use Local Storage Objects such as HTML5 to store content information and preferences. Third parties with whom we partner to provide certain features on our site or to display advertising based upon your web browsing activity use LSOs such as HTML5 to collect and store information.

Information Related to Data Collected for our Clients: ATL collects information under the direction of its Clients and has no direct relationship with the individuals whose personal data it processes. If you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our service, please contact the Client directly with whom you interact. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Clients.

Access and Retention of Data Controlled by our Clients: If you seek access, correction, amendment, or deletion of inaccurate data collected by our Clients, please direct your request to the Client who is the data controller. If requested to remove data, we will respond within 30 days.

We will retain personal data we process on behalf of our Clients for as long as needed to provide our services. We will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

WHY WE COLLECT THIS INFORMATION 

We process personal data for the following purposes: 

  • to enable us to perform the contract we have signed with our customers, suppliers or partners 

  • to enable contract management e.g. to send our invoices to our customers 

  • to enable us to run, maintain and develop our business 

  • to enable us to offer and provide our Services 

  • to enable customer service management e.g. when Users contact our team 

  • to enhance our Services and the use thereof 

  • to perform research and analysis relating to our Services 

  • to perform tracking of the use of our Services 

  • to conduct market surveys and/or to detect fraud

HOW WE PROCESS 

We process personal data to either provide (you with) the requested Service, or to pursue our legitimate interest to run, maintain and develop our business. Furthermore, we process personal data to comply with our legal obligations. 

In some parts of our Services, we might request Users consent for the processing of their personal data for specific purposes. In that event, Users may withdraw their consent at any time. 

ATL does not retain user data for longer than is legally permitted or necessary for the related processing purposes. The data held is to support our legal and regulatory requirements. We erase personal data after the legally permitted or necessary storage period or when the User requests us to erase his/her personal data.

GENERAL INFORMATION ON THE LEGAL BASIS FOR THE DATA PROCESSING 

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9 (2)(a) GDPR, if special categories of data are processed according to Art. 9 (1) GDPR. In the case of explicit consent to the transfer of personal data to third countries, the data processing is also based on Art. 49 (1)(a) GDPR. The consent can be revoked at any time. If your data is required for the fulfilment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, if your data is required for the fulfilment of a legal obligation, we process it on the basis of Art. 6(1)(c) GDPR. Furthermore, the data processing may be carried out on the basis of our legitimate interest according to Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.

HOW WE SHARE YOUR INFORMATION 

Personally Identifiable Information: We will not rent or sell your personally identifiable information to others. We may store personal information in locations outside our direct control (such as servers or databases co-located with hosting providers or third-party cloud infrastructure).

Non-Personally Identifiable Information: We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for certain ATL services and those of our partners. Our partners also have the option to publish the test results for their websites on the Service. These results consist solely of non-personally identifiable information. By publishing your results on the ATL Service, you agree that you have obtained all necessary consents to make such information public and that doing so will not violate any laws. If you remove information that you have made public on the Service, copies may remain viewable in cached and archived pages of the Service, or if other Users have copied or saved that information. Non-personally identifiable information may be stored indefinitely.

Instances where we are required to share your information: We may disclose your information where required by law, subpoena, or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) enforce our Terms of Service or protect the security or integrity of our Service; and/or (c) exercise or protect the rights, property, or personal safety of ATL, our Users, or others.

Change of Control: In the event of a change of control, such as a sale or transfer of the company or its assets, your information may be among the items sold or transferred. We will notify you via email and/or a prominent notice on our website of any change in ownership or use of your personal information, as well as any choices you may have regarding your personal information.

Behavioral Targeting / Re-Targeting: We may partner with third parties to display advertising on our website or manage our advertising on other sites. These third-party partners may use technologies such as cookies to gather information about your activities on this site and other sites in order to provide you with advertising based on your browsing activities and interests. If you wish to opt-out of having this information used for the purpose of serving you interest-based ads, you may click here. Please note that opting out does not mean you will no longer receive ads, but rather that the ads you see may not be tailored to your specific interests.

The ATL Privacy Policy does not apply to, and we cannot control the activities of, third-party ad servers and ad networks. Please consult the respective privacy policies of these ad servers or ad networks for more information.

STORAGE DURATION 

The storage period of your personal data will primarily depend on the purpose for which they were collected. In this regard, we guarantee that your data will not be kept longer than necessary to perform the purpose for which it was collected.

Irrespective of the above, in certain cases we will have the legal obligation to keep certain data for a longer period then what is necessary to achieve the purpose of processing. In these cases, personal data will be stored only within the minimum statutory prescribed term.

HOW WE PROTECT YOUR INFORMATION 

We are committed to protecting your privacy and data. However, we cannot guarantee the security of any information you transmit to us or the security of our Service. We maintain industry-standard physical, technical, and managerial safeguards to help protect your information from unauthorized access, disclosure, alteration, or destruction. When you enter sensitive information (such as a credit card number or login credentials), we encrypt the transmission of that information using secure socket layer technology (SSL).

RECIPIENTS OD PERSONAL DATA 

In the scope of our business activities, we cooperate with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only disclose personal data to external parties if this is required as part of the fulfilment of a contract, if we are legally obligated to do so (e.g., disclosure of data to tax authorities), if we have a legitimate interest in the disclosure pursuant to Art. 6 (1)(f) GDPR, or if another legal basis permits the disclosure of this data. When using processors, we only disclose personal data of our customers on the basis of a valid contract for data processing. In the case of joint processing, a joint processing agreement is concluded.

YOUR DATA AND THIRD COUNTRIES 

The information collected through the Service may be stored and processed in any country where ATL or its subsidiaries, affiliates, or service providers maintain facilities. Information may be transferred across borders from your country or jurisdiction to other countries or jurisdictions around the world.

YOUR RIGHTS 

For the purpose of effective control over the processing of your personal data, you have numerous rights, which may be exercised directly towards ATL, if certain statutory conditions are met. 

To this end, you have the following rights:

  • The right to ask for information on how ATL is processing your data. If ATL processes your personal data, you have the right to request detailed information on the respective processing, information about your stored personal data, their source, recipients, as well as the purposes of processing your personal data at any time;

  • Right to access your personal data – to gain a copy of processed data in physical or digital form;

  • Right to rectification of your incorrect or incomplete personal data we possess;

  • Right to ask for deletion of your personal data we possess;

  • Right to ask for restriction of processing of your personal data – this right applies in the following cases:

    • If you should dispute the that your data archived by us are correct, we will usually need some time to verify this claim. During the time that this investigation is ongoing, you have the right to demand that we restrict the processing of your personal data.

    • If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data instead of demanding the eradication of this data.

    • If we do not need your personal data any longer and you need it to exercise, defend or claim legal entitlements, you have the right to demand the restriction of the processing of your personal data instead of its eradication.

    • If you have raised an objection pursuant to Art. 21(1) GDPR, your rights and our rights will have to be weighed against each other. As long as it has not been determined whose interests prevail, you have the right to demand a restriction of the processing of your personal data.

  • If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.

  • Right to ask for your personal information to be transferred to another controller – You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

  • Right to object to the processing of your personal data by ATL, especially in cases of direct marketing based on the legitimate interest of ATL and automated processing; 

  • Right to withdraw the consent for processing of your personal data at any time, if the processing is based on your consent – If you have consented to data processing, you have the option to revoke this consent at any time;

In case you want to exercise any of the above rights (except for the last one), please contact us on email dpo@adtechlab.eu. Please note that in order to successfully process your application, you must first identify yourself (e.g. by sending a copy of the ID card). The personal data provided will be used solely for identification purposes and will be deleted immediately upon identification.

Exercising the above rights is completely free of charge. However, in the event that your requests for exercising any of the above rights are manifestly unfounded or excessive (e.g. due to frequent repetitions within a short period of time), we reserve the right, at our own discretion, to (i) charge a reasonable fee for the claim or (ii) to decline to act upon your request.

UPDATES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in legal or regulatory requirements, industry best practices, or our data processing activities. We will notify you of any material changes to the Privacy Policy by posting the updated version on our website or through other communication channels.
